Mr. Rosenblat’s law practice focuses on defending health care providers, white collar defendants, and representing whistleblowers under the federal or state False Claims Act. As a former active duty Army Judge Advocate General, Mr. Rosenblat represents active duty and reservists in adverse military actions.

Health Care Defense

Health insurance companies and federal and state health care programs routinely conduct health care related audits. These audits can result in recoupments, termination of billing privileges, civil prosecution, typically under the False Claims Act, or criminal prosecution. Mr. Rosenblat has successfully represented providers in all of these and related matters.

Medicare and Medicaid Audit Defense

Healthcare providers are routinely audited, usually based on an agency’s assertion that there is “credible evidence regarding data analysis findings.” Attorney Rosenblat will deliver the provider with legal and practical guidance regarding the record production and steps moving forward. If the health insurance company, Medicare, or Medicaid determines that there was an overpayment, appealing this determination is critical for the provider.

Successful results have included no recoupment to significantly reduced recoupment demands.

White Collar Defense

Mr. Rosenblat’s experience in health care investigations gives him the background and knowledge to represent those being investigated or charged with a health care related criminal offenses.

False Claims Act

Mr. Rosenblat has the understanding and knowledge to successfully represent individuals under the False Claims Act, who have evidence of fraud being perpetrated against the government. He is the author of Prosecuting a Claim Under the Illinois False Claims Act. He has successfully represented the whistleblower/relator in U.S., ex Rel. Tyson v. Amerigroup Illinois, Inc., which after trial settled for $225 million, and Stericycle, which settled for $26.75 million.

Military Law

Mr. Rosenblat has been successfully representing members of the armed forces since he served as an active duty infantry and JAG officer in the U.S. Army.

 Mr. Rosenblat attended basic training at Fort Leonard Wood, and Officer Candidate School at Fort Moore, formerly Fort Benning, in Georgia. After graduating from Officer Candidate School, Mr. Rosenblat was commissioned as a Second Lieutenant and branched infantry. Lieutenant Rosenblat then completed his infantry officer’s course and airborne school. Lieutenant Rosenblat was then assigned as a platoon leader with the 7^th Infantry Division, Fort Ord, California. After having served as a platoon leader and in a garrison position, Lieutenant Rosenblat branch transferred to the Judge Advocate Generals Corps, attended the JAG officers’ course, was promoted to Captain, and was assigned as a trial counsel, prosecutor, with the 9^th Infantry Division at Fort Lewis, Washington. While with the 9^th Infantry Division, Captain Rosenblat was deployed with the 593^rd Area Support Group to Dharan, Saudi Arabia, as the unit’s Command Judge Advocate. Upon being redeployed to Fort Lewis, Captain Rosenblat was assigned to Trial Defense Services as a military defense attorney.
